1. Acceptance of Terms

By accessing or using AccessyAI (“the Service”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, you must not use the Service.

In these Terms, “Biiig.Studio”, “we”, “us”, and “our” refer to the operator of AccessyAI (ABN 62 549 755 047) trading as Biiig.Studio. “You” and “your” refer to the individual or entity using the Service.

2. Service Description

AccessyAI is an automated web accessibility auditing tool that analyses web pages against the Web Content Accessibility Guidelines (WCAG) 2.2. The Service provides accessibility scores, identifies violations, and offers optional AI-powered remediation suggestions through integration with third-party AI services.

The Service is provided on an “as available” basis. We may modify, suspend, or discontinue any part of the Service at any time without prior notice.

3. Eligibility

You must be at least 18 years of age or an authorised representative of an organisation to use the Service. By using AccessyAI, you represent and warrant that you meet this eligibility requirement.

4. Beta Access

AccessyAI is currently in beta. Access is granted through a waitlist-based system. We may approve or reject access at our sole discretion. Beta access is authenticated via a browser cookie and does not require a traditional username and password account.

The beta Service may contain bugs, may change without notice, and may be discontinued at any time. We are not obligated to provide technical support, bug fixes, or updates during the beta period. You should not rely on the Service for critical business or compliance decisions without independent verification. We are not liable for any loss of data or audit results during the beta.

5. Acceptable Use

You may only use AccessyAI to scan websites that you own or for which you have explicit permission to test. You must be the website owner, an employee or contractor of the website owner, or have written authorisation to conduct accessibility testing.

You must:

  • Comply with all applicable laws in your jurisdiction when using the Service
  • Use the Service in good faith for its intended purpose of accessibility testing and improvement

You must not:

  • Scan websites without authorisation. Scanning a website you do not own or have permission to test may violate laws regarding unauthorised access.
  • Use the Service for competitive intelligence or scraping. The Service is for accessibility improvement, not for harvesting data about competitors' websites.
  • Attempt to circumvent rate limits or security measures implemented by the Service.
  • Use the Service to find or exploit security vulnerabilities on target websites. The Service is for accessibility testing only.
  • Submit malicious URLs designed to attack, compromise, or disrupt the Service or its infrastructure.
  • Reverse-engineer the platform, including its scoring algorithms, crawling mechanisms, or AI integration.
  • Resell or redistribute audit results as your own service without prior written agreement from Biiig.Studio.

Biiig.Studio reserves the right to suspend or permanently terminate access for any user who violates this section, without prior notice. We may also report illegal activity to the appropriate authorities.

6. Intellectual Property

All intellectual property rights in the AccessyAI platform, including its software, design, scoring algorithms, and documentation, are owned by Biiig.Studio. You retain ownership of the data you provide (submitted URLs) and the audit results generated for your websites.

Any feedback, suggestions, or ideas you provide about the Service may be used by us without restriction or obligation to you.

7. Audit Results & Disclaimers

AccessyAI is an automated accessibility auditing tool. It is designed to assist you in identifying potential accessibility issues on your website. It is not a substitute for manual accessibility testing, expert evaluation, or a professional accessibility audit conducted by qualified practitioners.

Audit results are provided “as is” for informational purposes only. They do not constitute legal advice and are not guaranteed to be complete or error-free. Accessibility requirements vary by jurisdiction and context. If you need advice about your legal obligations regarding accessibility, you should consult qualified legal counsel.

Automated accessibility testing is inherently limited. Research by the UK Government Digital Service and others indicates that automated tools can typically detect approximately 30–40% of WCAG success criteria. Many accessibility issues — such as the quality of alternative text, the logical order of content, or the usability of complex interactive components — require manual testing by people with disabilities and accessibility expertise. A clean AccessyAI report does not mean your website is fully accessible.

Passing an AccessyAI audit, achieving a high score, or implementing our suggestions does not guarantee conformance with WCAG 2.2 or any other accessibility standard. It does not guarantee compliance with the Disability Discrimination Act 1992 (Australia), the European Accessibility Act, the Americans with Disabilities Act, or any other applicable legislation.

8. AI-Generated Content

AccessyAI offers optional AI-powered remediation suggestions generated by a third-party AI service (Anthropic Claude). These suggestions:

  • Are provided as a starting point and may contain inaccuracies
  • Should be reviewed and validated by a qualified developer before implementation
  • May not account for the specific context of your website or application
  • Should be tested thoroughly, including with assistive technologies, before deployment

You are solely responsible for reviewing, validating, and testing any AI-generated code or recommendations before implementing them.

We do not warrant that AI-generated suggestions are free from intellectual property claims. AI outputs may resemble existing code or solutions. You are responsible for ensuring any implemented suggestions do not infringe third-party rights.

9. Third-Party Websites

AccessyAI scans websites at URLs you provide. We are not responsible for the content, accuracy, or accessibility of those third-party websites. Scanning a website does not imply any endorsement of or affiliation with that website.

10. Data Handling

Your use of the Service is subject to our Privacy Policy, which describes how we collect, use, and protect your information.

11. Limitation of Liability

To the maximum extent permitted by law, including the Australian Consumer Law (Competition and Consumer Act 2010, Schedule 2), the information and services provided by AccessyAI are provided “as is” without warranties of any kind, whether express or implied. Biiig.Studio does not warrant that the Service will be uninterrupted, error-free, or completely accurate.

We shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.

Our total aggregate liability for any claim arising from or related to the Service shall not exceed the amount you have paid us for the Service in the twelve months preceding the claim (which, during the free beta period, is nil).

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred by the Australian Consumer Law or any other applicable law that cannot be excluded, restricted, or modified by agreement. Where our liability for breach of a non-excludable consumer guarantee cannot be excluded, it is limited (to the extent permitted by law) to the re-supply of the Service or payment of the cost of having the Service re-supplied.

12. Indemnification

You agree to indemnify us against any claims, losses, or damages (including reasonable legal fees) arising directly from:

  • Your breach of these Terms
  • Scanning websites without proper authorisation from the website owner
  • Your violation of any applicable law while using the Service

13. Termination

We may suspend or terminate your access to the Service at any time for any reason, including a breach of these Terms. Where reasonably practicable, we will provide notice before termination, except where immediate action is required to prevent harm to the Service or other users. You may request deletion of your data at any time by contacting us at info@accessyai.com.

14. Force Majeure

We are not liable for any failure or delay in performing our obligations where such failure or delay results from circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, government actions, cyberattacks, or failures of third-party services (including the Anthropic API or database hosting providers).

15. Changes to These Terms

We may update these Terms from time to time. Changes will be posted on this page with an updated “Last updated” date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

16. Governing Law

These Terms are governed by the laws of Australia. Any disputes arising under these Terms shall be subject to the non-exclusive jurisdiction of the courts of Australia.

17. Severability & Entire Agreement

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Biiig.Studio regarding the use of AccessyAI.
